1. Rol de la plataforma
Trabajos Particulares (la «Plataforma») es un directorio en línea que permite a los trabajadores publicar servicios para que los clientes potenciales los vean. La Plataforma no es un empleador, agente ni intermediario. Solo proporciona espacio publicitario.
2. Condición de contratista independiente
Como Trabajador, usted reconoce ser un contratista independiente. No es empleado, socio, agente ni representante de la Plataforma.
3. Licencias, permisos y cumplimiento
Usted es el único responsable de asegurarse de contar con todas las licencias, permisos, seguros, fianzas y cualificaciones requeridas por ley para prestar sus servicios. La Plataforma no verifica ni garantiza su cumplimiento.
4. Sin garantía de trabajo
Su membresía solo le proporciona visibilidad publicitaria. La Plataforma no garantiza que lo contacten, lo contraten ni le paguen por su trabajo.
5. Liberación de responsabilidad
Usted acepta liberar, defender y eximir de responsabilidad a la Plataforma, sus propietarios y afiliados de cualquier reclamo, pérdida, daño, disputa o responsabilidad que surja de su listado, servicios o interacciones con los Usuarios.
6. Indemnización
Usted acepta indemnizar a la Plataforma frente a cualquier reclamación presentada por los Usuarios o terceros relacionada con su conducta, servicios o incumplimiento de obligaciones legales.
7. Pagos
Las cuotas de membresía son solo para publicidad y publicación en directorios. No son reembolsables, salvo que lo exija la ley.
8. Terminación
La Plataforma se reserva el derecho de eliminar su listado o cancelar su cuenta a su entera discreción por violaciones de estos términos o mal uso de la Plataforma.

La Plataforma no examina, verifica ni garantiza la identidad, antecedentes, licencias, seguros ni calificaciones de los Trabajadores enumerados.
3. Su responsabilidad
Usted es el único responsable de evaluar, verificar y seleccionar a cualquier trabajador. Debe realizar su propia diligencia debida antes de contratarlo, incluyendo la verificación de licencias, referencias y seguros .
4. Sin garantía
La Plataforma no ofrece ninguna garantía sobre la calidad, seguridad, legalidad ni resultados de los servicios prestados por los Trabajadores. El uso de la Plataforma es bajo su propia responsabilidad.
5. Liberación de responsabilidad
Usted acepta liberar, defender y eximir de responsabilidad a la Plataforma, sus propietarios y afiliados de cualquier reclamo, daño, pérdida, lesión o disputa que pueda surgir de la contratación o el trato con cualquier Trabajador.
6. Indemnización
Usted acepta indemnizar a la Plataforma contra cualquier reclamo presentado por los Trabajadores o terceros relacionados con su uso de la Plataforma o sus tratos con los Trabajadores.
7. Terminación
La Plataforma se reserva el derecho de suspender o cancelar su cuenta a su entera discreción por mal uso o violaciones de estos términos.

Welcome to Trabajos Particulares (“the Platform”). By registering, accessing, or using the Platform, whether as a Worker or a User, you agree to the following Terms & Conditions. Please read them carefully.
1. Role of the Platform
The Platform is an online directory that connects Users (individuals seeking services) with Workers (individuals or businesses offering services).

The Platform does not employ, supervise, or control Workers.

The Platform’s role is limited to providing advertising and access to listings.

The Platform is not a party to any agreements between Users and Workers.
2. Independent Parties

Workers are independent contractors, not employees, agents, or representatives of the Platform.

Users engage Workers at their own discretion and risk.

Any disputes, negotiations, or payments are strictly between Users and Workers.
3. No Verification or Endorsement

The Platform does not verify the identity, background, licenses, insurance, or qualifications of Workers.

Listings do not represent endorsements or guarantees by the Platform.

Users are solely responsible for conducting due diligence before hiring.
4. User Responsibilities
If you are a User:

You agree to evaluate, verify, and confirm that a Worker is qualified and legally permitted to perform services.

You assume all risks associated with hiring, paying, or interacting with a Worker.
5. Worker Responsibilities
If you are a Worker:

You agree that you are solely responsible for maintaining required licenses, permits, certifications, and insurance.

You must comply with all applicable laws, regulations, and industry standards.

You acknowledge that payment of membership fees does not guarantee jobs, income, or customer contacts.
6. Fees and Payments

Workers may be charged membership fees for advertising and listing services.

All membership payments are for directory exposure only and are non-refundable, except where required by law.

Users are not charged by the Platform to access listings.
7. No Warranty
The Platform is provided on an “as is” and “as available” basis.

The Platform makes no warranties, express or implied, about the quality, safety, legality, or performance of Workers or their services.

The Platform does not guarantee that Workers will be hired or that Users will be satisfied with services.
8. Limitation of Liability
To the fullest extent permitted by law:

The Platform shall not be liable for any damages, losses, disputes, injuries, or claims arising out of or related to interactions, communications, or transactions between Users and Workers.

Your sole remedy for dissatisfaction with the Platform is to stop using it.
9. Indemnification
You agree to indemnify and hold harmless the Platform, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform or your dealings with any User or Worker.
10. Termination
The Platform reserves the right to suspend or terminate any account, listing, or access at its sole discretion for violations of these terms, suspected fraud, or misuse of the Platform.
11. Governing Law
